APPLE, INC.’S MOTION TO
SHORTEN TIME
(Docket No. 315)
Defendant Apple, Inc. (“Apple”) moves to shorten time on its motion to compel Elan’s

compliance with the parties’ agreement that Elan employees will be presented for deposition in the
19
Northern District of California. Having reviewed the papers and considered the arguments of
20
counsel, Apple’s motion to shorten time is GRANTED.

Apple complains that Elan refuses to make its employees available for deposition in the
22
Northern District of California despite the parties’ prior agreements that named inventors and
23
employees of the parties that do not reside in the United States would be made available for
24
deposition here. In support of its motion, Apple notes that a similar issue regarding deposing the
25
named inventors in the Northern District of California pursuant to the parties’ same agreements is
26
scheduled for hearing next week on July 5, 2011.

A hearing on the above motion shall be held on July 5, 2011 at 10AM (along with Apple’s

previously noticed motion to compel). Elan may file an opposition to the motion to compel no later

than July 1, 2011. No reply will be considered.
