(“Elan”) and 2 Defendant APPLE INC. (“Apple”), announced to the Court that they have settled their respective 3 claims for relief asserted in this case. The Court, having considered this request, is of the opinion 4 that their request for dismissal should be granted. 5 IT IS THEREFORE ORDERED that all claims for relief asserted against Apple by 6 Elan herein are dismissed, with prejudice, and all counterclaims for relief against Elan by Apple 7 are dismissed with prejudice; and 8 9 IT IS FURTHER ORDERED that all attorneys’ fees, costs of court and expenses shall be borne by each party incurring the same. 10 11 12 9th Signed this _______ day of January 2012. ___________________________________ HON.
