The parties have a hearing today before the U.S. International Trade Commission in Washington D.C. Counsel for the parties met and conferred today in person regarding this motion, and counsel for Defendant Apple, Inc. agreed that a five day extension for the filing of the reply claim construction briefs would be appropriate. On this basis, Elan respectfully requests that the Court enter an order extending the claim construction briefing schedule as follows: Event Parties will file their rely patent claim construction briefs pursuant to Pat. L.R. 45(c). Old Date May 28, 2010 New Date June 2, 2010 Three of the five days are weekend days or holidays. Because there are no dates in the Court's Scheduling Order following the claim construction hearing, and the hearing date will not change, extension of this deadline will not necessitate additional changes to the schedule.
