Following an initial review of the petition, the court found petitioner’s 18 claims cognizable and ordered respondent to show cause why the petition should not be granted. 19 Currently pending before the court are petitioner’s motion for discovery, motion seeking 20 assistance, and motion for an evidentiary hearing. Respondent is directed to file a response to 21 petitioner’s motion for discovery, motion seeking assistance, and motion for evidentiary hearing, 22 addressing the implications of the Supreme Court’s decision in Cullen v. Pinholster, 131 S. Ct. 23 1388 (2011), within thirty days from the filing date of this order.
