ORDER OF DISMISSAL
Plaintiff, a California state prisoner, filed a pro se civil rights complaint pursuant to 42
17
U.S.C. § 1983. On June 5, 2012, the court granted defendants’ motion to dismiss plaintiff’s
18
amended complaint for failure to state a claim, and dismissed the amended complaint with leave
19
to amend. In the order, the court ordered plaintiff to file a second amended complaint curing the
20
noted deficiencies within thirty days of the filing date of the order. The court warned that if he
21
failed to file a response within the court’s deadline, it would result in the dismissal of this action
22
without prejudice. More than thirty days have elapsed and the court has received no response
23
from plaintiff.

Accordingly, the instant action is DISMISSED without prejudice. The clerk shall
terminate all pending motions and close the file.
