This Stipulation is entered into between Plaintiff ERIN S. PEARCE ("Plaintiff") and Defendant BANK OF AMERICA HOME LOANS formerly known as COUNTRYWIDE HOME LOANS, INC. ("Defendant"). Defendant's moved to dismiss Plaintiff's Complaint on December 15, 2009. A hearing on their motion is currently scheduled for 9:00 a.m. on February 12, 2010, the Honorable Judge Jeremy Fogel presiding. In light of the pending motion to dismiss, and that pleadings have not been set, Plaintiff and Defendant, through their respective counsel of record, agree and jointly request that the filing
