STIPULATION TO STAY THE LITIGATION Plaintiff, Textscape LLC and Defendant Google Inc. ("Google") hereby stipulate to stay this case pending the outcome of the reexamination of U.S. Patent No. 5,713,740 ("the `740 Patent").

On June 16, 2010, Defendant Google filed a Motion to Stay the current action pending reexamination of the `740 Patent and concurrently filed a Motion for Summary Judgment of Invalidity. (Doc. 52). Plaintiff Textscape has considered the points raised in Google's Motion to Stay and is now in agreement. In particular, the United States Patent and Trademark Office ("USPTO") granted the Request for Ex Parte Reexamination under 37 C.F.R. § 1.5.10 on May 13, 2010. Accordingly, Textscape and Google hereby request that the Court stay the current litigation pending final outcome, including any appeals, of the reexamination of the `740 patent filed by Google Inc. on April 2, 2010 with the United States Patent and Trademark Office.
