The action was removed to this Court on October 13, 2009. Plaintiff has filed a motion for permission to file papers in this case electronically. That motion is GRANTED. Defendant Wells Fargo Bank dba America's Servicing Company has filed a motion to dismiss the complaint for failure to state a claim, which is set for hearing on February 19, 2010. Plaintiff has filed a motion for leave to file a first amended complaint, which is set for hearing on March 12, 2010. Pursuant to Federal Rule of Civil Procedure 15(a), "[a] party may amend the party's pleading once as a matter of course at any time before a responsive pleading is served."
