ORDER CLARIFYING IN LIMINE RULING 12 13 THOMAS MCKAY, et al., Defendants. 14 15 16 The order precluding evidence or argument regarding the financial resources of any party 17 does not preclude plaintiff from introducing evidence regarding his unemployment and his claim 18 of resulting emotional distress, to the extent otherwise relevant and admissible. It is improper, and 19 will not be allowed, for a party to use claims of impoverishment, or contentions as to another 20 party’s wealth, to attempt to inflame the passions, prejudices, or sympathy of the jury. This 21 clarification resolves plaintiff’s motion for leave to seek reconsideration, which shall be 22 terminated without further briefing or hearing. 23 24 IT IS SO ORDERED. 25 26 27 28 Dated: November 20, 2014 ______________________________________ RICHARD SEEBORG United States District Judge
