1 2011, before JAMS mediator John Bates in San Francisco, California. The parties will split the
2 costs of the mediation and will promptly notify the Court whether the case is resolved at the
3 conclusion of the mediation. The parties intend to hold this private mediation in place of the panel
4 mediation the Court referred to in its July 29, 2011 Order Referring Parties to Panel Mediation.
