LIMITED WARRANTY STATEMENT
This limited warranty shall apply to the HTC device and any accessories supplied together with the device, (together referred to as the "Product"). HTC warrants that the Product is at the time of its original purchase free of defects in materials and workmanship ("Limited Warranty"). This Limited Warranty is subject to the following terms and conditions: 1. This Limited Warranty is given only to the original purchaser of the Product ("Customer"). It shall neither exclude nor limit: a) any statutory rights of the Customer or b) any of the Customer's rights against the seller/dealer of the Product. 2. This Limited Warranty shall last for twelve (12) months from the date of original purchase unless a longer Warranty Period is required by applicable law in the end customer's location. ("Warranty Period") Customer shall present the PROOF OF PURCHASE upon claiming this Limited Warranty. Any claim under this Limited Warranty is subject to the Customer notifying HTC or an HTC authorized service agent of the alleged defect within a reasonable time of it having come to the Customer's attention and in any event no later than before the expiry of the Warranty Period. This Limited Warranty may not be sold-on, assigned, transferred or given to any subsequent purchaser or acquirer of the Product. This Limited Warranty is only valid and enforceable in the countries where the Product is purchased. Moreover, if Product is returned to be repaired under this Limited Warranty in a place other than where it was purchased

or the place HTC designated to provide repair, HTC will attempt to repair such Product but cannot guarantee the ability to make repairs. 3. Throughout the Warranty Period HTC or its authorized agent will, at their discretion, without charge and subject to Clause 7, repair or replace a defective Product. Repair or replacement may involve the use of functionally equivalent reconditioned units. HTC will return the repaired or replaced Product to the Customer in good working condition. All replaced faulty parts or components will become the property of HTC. 4. This Limited Warranty applies only to the hardware components of the Product as originally supplied and software the Product is originally embedded with. This Limited Warranty does not cover physical damage to the surface of the Product, including but not limited to cracks or scratches on the LCD screen or camera lens. 5. If HTC repairs or replaces the Product, the repaired or replaced Product shall continue to be warranted for the remaining time of the original Warranty Period or for three (3) months from the date of repair or replacement, whichever is longer. 6. Before returning any unit for service, Customer should be sure to back up data and remove any confidential, proprietary, or personal information from the Product. HTC is not responsible for the damage to or loss of any programs, data, or removable storage media. 7. THIS LIMITED WARRANTY SHALL NOT APPLY IF: a) the Product serial number, the accessory date code, the IMEI number, the water indicator, or the warranty seal has been removed, erased, defaced, altered or is illegible; or b) the defect was caused by deterioration of the Product due to normal wear and tear; or c) the defect was caused by use other than in accordance with the user manual, rough handling, exposure to moisture, dampness or extreme thermal or environmental conditions or a rapid change in

such conditions, corrosion, oxidation, unauthorized modifications or connections, unauthorized opening or repair, repair by use of unauthorized spare parts, accidents, forces of nature, or other actions beyond the reasonable control of HTC (including but not limited to deficiencies in consumable parts) unless the defect was caused directly by defects in materials or workmanship; or d) the defect was caused by the fact that the battery has been shortcircuited or by the fact that the seals of the battery enclosure or the cells are broken or show evidence of tampering or by the fact that the battery has been used in equipment other than those for which it has been specified; or e) the defect was caused by a defective function of the cellular network or other system; or f) the Product software needs to be upgraded due to changes in cellular network parameters; or g) the defect was caused by the fact that the Product was used with or connected to an accessory not approved or provided by HTC or used in other than its intended use and where it can be shown by HTC that such defect is not the fault of the Product itself; or h) the bootloader is unlocked by the Customer (allowing third party OS installation) using the fastboot program. 8. The Product may contain country specify elements, including software. If the Product has been re-exported from its original destination country to another country, the Product may contain country specific elements that are not considered to be a defect under this Limited Warranty. 9. In the event of Product failure, the Customer should take the following actions: a) Refer to the user manual and other online support materials in order to identify and possibly correct the problem. b) If the problem cannot be resolved by reference to the user manual the Customer should then refer to the support page for customer service on the HTC website: www.htc.com , for instructions on how to contact an

HTC service agent. c) Before the Customer contacts HTC service agent, please ensure the following information is at hand: The model and serial number, IMEI/ESN number of the Product. The Customer's full address and contact information. A copy of the Customer's original invoice, receipt or bill of sale of the purchase of the Product. HTC will provide the Customer with instructions regarding how and when the defective Product should be returned. HTC will pay costs in connection with both the return of the defective product to HTC and the repaired Product back to the Customer if the Defective Product is within the Warranty Period. 10. THIS LIMITED WARRANTY STATES THE ENTIRE WARRANTY GIVEN BY HTC TO THE CUSTOMER. ALL IMPLIED WARRANTIES OF SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE RELEVANT WARRANTY PERIOD. IN NO EVENT SHALL HTC BE LIABLE FOR INCIDENTAL OR CONSEQUENTAL LOSSES OR DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOST PROFITS OR COMMERCIAL LOSS, TO THE FULLEST EXTENT THAT THOSE LOSSES OR DAMAGES CAN BE DISCLAIMED BY LAW. IN ANY CASE HTC'S AND ITS SUPPLIERS' ENTIRE LIABILITY UNDER ANY PROVISION OF THIS LIMITED WARRANTY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THE HARDWARE. HTC does not exclude or limit liability for personal injury or death resulting from its own negligence. Some countries do not allow exclusions or limitation of incidental or consequential loss or damage, or limitation of the duration of implied warranties. In those circumstances the preceding limitations or exclusions may not apply to such Customers. This warranty gives the Customer specific legal rights; the Customer may also have other rights, which may vary from country to country. This limited warranty does not affect the Customer's statutory rights in law specific to the country of purchase; such rights remain protected. HTC End User License Agreement

IMPORTANT -- READ CAREFULLY BEFORE USING THIS SOFTWARE:

This License Agreement ("License Agreement") for a certain HTC product is a legal agreement between you (either an individual or an entity) and HTC Corporation and its third party suppliers and licensors (collectively "HTC") for all the relevant software (which includes components provided by suppliers and licensors to HTC) bundled with the HTC product purchased by you ("Software"). Title, ownership rights and intellectual property rights in and to the content accessed through the Software including the content contained in the Software media demonstration files, shall be retained by the applicable Content owner and may be protected by applicable copyright or other law. This license gives you NO rights to such Content. 4. DISCLAIMER OF WARRANTY & LIMIT OF LIABILITY. THE SOFTWARE, DOCUMENTATION, AND CONTENT ARE PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND. HTC FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SOFTWARE, DOCUMENTATION, AND CONTENT REMAINS WITH YOU. IN NO EVENT SHALL HTC AND ITS EMPLOYEES OR LICENSORS OR AFFILIATES BE HELD LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS

INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE SOFTWARE OR THE CONTENT, EVEN IF HTC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HTC's TOTAL LIABLITY FOR ANY DAMAGES UNDER THIS AGREEMENT SHALL NEVER EXCEED THE PURCHASE PRICE YOU PAID FOR THE HTC PRODUCT YOU BOUGHT. Any software is not fault tolerant whether provided by a third party or HTC. Where you installed the software on the device, HTC is not responsible for how it operates on the device. The software was designed for systems that do not require fail-safe performance. You may not use the software in any device or system in which a malfunction of the software would result in foreseeable risk of loss, injury or death to any person. This includes operation of nuclear facilities, medical equipment, aircraft navigation or communication systems, air traffic control or use in risky and dangerous situations or environments. 5. INDEMNIFICATION. You agree to hold harmless, indemnify and defend HTC, its officers, directors and employees, from and against any losses, damages, fines and expenses (including attorneys' fees and costs) arising out of or relating to any claims that you have (i) viewed, downloaded, encoded, compressed, copied or transmitted any materials (other than materials provided by HTC) in connection with the Software in violation of another party's rights or in violation of any law, or (ii) violated any terms of this License Agreement. If you are importing the Software from the United States or European Union, you shall indemnify and hold HTC harmless from and against any import and export duties or other claims arising from such importation. You agree that the laws of the State of Washington, the United States (excluding its conflict of laws) shall govern any and all matters resulted from this Agreement. 6. TERMINATION. This License Agreement will automatically terminate if you fail to comply with any term hereof. No notice shall be required from HTC to effect such termination. www.htc.com

b) le défaut a été causé par la détérioration du Produit due à l'usure normale ; ou c) le défaut a été causé par une utilisation contraire aux instructions du manuel d'utilisation, une manipulation brutale, une exposition à l'humidité ou à des conditions thermiques ou environnementales extrêmes ou une modification rapide de ces conditions, la corrosion, l'oxydation, des modifications ou des connexions non autorisées, une ouverture ou réparation, une réparation non autorisée, une réparation avec l'utilisation de pièces non autorisées, des accidents, les forces de la nature ou toutes autres actions raisonnablement indépendantes du contrôle de HTC (y compris, mais pas seulement, des déficiences dans les pièces remplacées périodiquement), à moins que le défaut ne soit causé directement par des défauts de matériel ou de fabrication ; ou d) le défaut a été causé par le court-circuit de la batterie, causé par la rupture ou l'altération des scellés sur le boîtier de la batterie ou causé par l'utilisation de la batterie dans équipement autre que celui pour laquelle elle a été spécifiée ; ou e) le défaut a été causé par une fonction défectueuse du réseau cellulaire ou d'un autre système ; ou f) les logiciels du Produit doivent être mis à jour du fait de modifications dans les paramètres du réseau cellulaire ; ou g) le défaut a été causé par l'utilisation ou la connexion du Produit avec ou à un accessoire non approuvé ou non fourni par HTC ou une utilisation autre que celle prévue et pour laquelle HTC peut démontrer qu'un tel défaut n'est pas dû au Produit lui-même ; ou h) le bootloader est déverrouillé par le Client (permettant l'installation d'un système d'exploitation tiers) en utilisant le programme fastboot. 8. Le Produit peut contenir des éléments spécifiques au pays, y compris les logiciels. Si le Produit a été réexporté de son pays de première destination vers un autre pays, le Produit peut contenir des éléments spécifiques au pays qui ne sont pas considérés comme un défaut dans le cadre de la présente Garantie Limitée.

9. En cas de panne du Produit, le Client doit procéder comme suit : a) Se reporter au manuel d'utilisation et autres documents de support en ligne afin d'identifier toute possible solution au problème. b) Si le problème ne peut pas être résolu en faisant référence au manuel d'utilisation, le Client doit alors se reporter à la page de support pour le service client sur le site Web de HTC : www.htc.com, pour des instructions sur comment contacter un agent de service HTC. c) Avant de contacter l'agent de service HTC, le Client doit s'assurer d'avoir préparé les informations suivantes : Le modèle et le numéro de série, le numéro IMEI/ESN du Produit. L'adresse complète et les informations de contact du Client. Une copie de la facture ou du reçu du Client pour l'achat du Produit. HTC fournira au Client des instructions sur la manière et la date de retour du Produit défectueux. HTC paiera les coûts à la fois pour le retour du Produit défectueux à HTC et pour le renvoi du Produit réparé au Client si le Produit défectueux est dans la Période de Garantie. 10. EN AUCUN CAS HTC ET SES EMPLOYÉS, CONCÉDANTS DE LICENCE OU AFFILIÉS, NE DOIVENT ÊTRE TENUS RESPONSABLE DE DOMMAGES INDIRECTS, ACCESSOIRES, INDIRECTS, SPÉCIAUX, PUNITIFS OU AUTRES QUE CE SOIT (Y COMPRIS, SANS LIMITATION, DOMMAGES POUR PERTE DE BÉNÉFICES D'AFFAIRES, INTERRUPTION D'ACTIVITÉ, PERTE D'INFORMATIONS COMMERCIALES OU AUTRES PERTES PÉCUNIAIRES) DUS À CE CONTRAT OU L'UTILISATION D'OU L'INCAPACITÉ D'UTILISER LE LOGICIEL, LA DOCUMENTATION OU LE CONTENU, MÊME SI HTC A ÉTÉ INFORMÉ DE LA POSSIBILITÉ DE TELS DOMMAGES. L'ENTIÈRE RESPONSABILITÉ DE HTC POUR TOUT DOMMAGE EN VERTU DE CE CONTRAT NE DÉPASSERA JAMAIS LE PRIX D'ACHAT VOUS AVEZ PAYÉ POUR LE PRODUIT HTC QUE VOUS AVEZ ACHETÉ. Aucun logiciel n'est insensible aux défaillances qu'il soit fourni par un tiers ou par HTC. Où vous avez installé le logiciel sur l'appareil, HTC n'est pas responsable de la manière dont il fonctionne sur l'appareil.
