The Court scheduled next week’s conference to update the Court regarding the viability of 18 ADR options and possible resolution of the case. As detailed in the Supplemental Joint Case 19 Management Conference Statement that will be filed on September 9, 2011, the parties’ recent 20 settlement efforts have proven unfruitful and ADR is viewed by Defendants as unlikely in the near 21 term. Thus, it is believed that the conference is unnecessary and should be adjourned.
