1 Procedure. On December 10, 2010, Judge Fogel granted Plaintiff’s application and granted leave
2 to serve by publication in an appropriate publication in Toronto Canada.
Evidence of the service of summons is filed herewith. On December 24, 2010, the

4 Toronto Star Newspaper published the Notice as evidenced by the Affidavit as to Insertion of
5 Notice.

On information and belief, Defendant’s Answer or motion under Rule 12 of the Federal

7 Rules of Civil Procedure were due on January 14, 2011. Plaintiff has not received any response
8 from the Defendant.
