The parties complied with the Court’s August 17, 2011 and duly filed their Show Cause

11

Response (See Docket Item No. 41). The parties relay in their joint statement that more time is

12

needed to finalize their settlement efforts. Accordingly, the Court continues the September 2, 2011

13

Show Cause hearing. The parties are ordered to appear before the Honorable Edward J. Davila on

14

October 7, 2011 at 9:00 AM in Courtroom No. 1, 5th Floor, United States District Court, 280 South

15

First Street, San Jose, California, 95113, to show cause why the case should not be dismissed

16

pursuant to Federal Rule of Civil Procedure 41(b). On or before September 30, 2011, the parties

17

shall file a joint statement in response to the Order to Show Cause setting forth the status of

18

settlement efforts as well as the amount of additional time necessary to finalize and file a dismissal.

19

The Order to Show Cause shall be automatically vacated and the parties relieved of the

20

obligation to file a joint statement if a stipulated dismissal pursuant to Federal Rule of Civil

21

Procedure 41(a) is filed on or before September 30, 2011.

22

All other pretrial deadlines and hearing dates are vacated.

23

Failure to comply with any part of this Order will be deemed sufficient grounds to dismiss

24

the action.
