These actions were consolidated pursuant to the Court’s March 15, 2011 Order (Dkt. No.

36) (“Order Consolidating Case”). On May 6, 2011, the Court issued a Related Case Order

3

regarding Jenkins, et al. v. Apple, Inc., Case No. 11-CV-01828 (Dkt. No. 76), in which the Court

4

found that the Jenkins action is related to these actions and ordered it reassigned to this Court.

5

The Order Consolidating Case provides that “[e]ach new case that arises out of the subject matter

6

of the Consolidated Action which is filed in this Court or transferred to this Court, shall be

7

consolidated with the Consolidated Action and this Order shall apply thereto, unless a party in

8

such newly filed or transferred action objects to consolidation … or any provision of this order,

9

within ten (10) days after the date upon which a copy of this Order is served on counsel for such

10

party ….” Counsel in the Jenkins action was served with a copy of the Order Consolidating Case

11

on April 14, 2011 (Dkt. No. 68-2). No objection to consolidation or the Order Consolidating

12

Case has been filed. Pursuant to the Order Consolidating Case, the Jenkins action is therefore

13

consolidated with these actions.
