STIPULATION AND [PROPOSED] ORDER Plaintiff MedioStream, Inc. ("MedioStream") and Defendant MPEG LA, L.L.C. ("MPEG LA") (collectively, the "Parties"), by and through their undersigned counsel, hereby agree and stipulate as follows: AGREEMENT MedioStream filed its Complaint for Declaratory Relief and 7 Breach of Contract on December 30, 2010 ("Complaint"). 8 2. On February 1, 2011, this Court set an initial case management 9 conference for April 1, 2011. (Dkt. # 8.) 10 3. MedioStream did not serve its Complaint on MPEG LA until 11 March 9, 2011, at which time it also served the notice of the initial case 12 management conference. 13 4. On March 18, 2011, MPEG LA advised MedioStream of its 14 intention to move to dismiss the Complaint for lack of subject matter jurisdiction. 15 After conferring about the substance of the motion and discussing available 16 hearing dates with the Court, the Parties agreed to hold the hearing on MPEG LA's 17 motion to dismiss at 9:00 a.m. on June 10, 2011. 18 19 1.
