WHEREAS, by order dated October 4, 2011, the Clerk of Court ordered a case management
conference for October 18, 2011;
WHEREAS, Local Rule 16-10(d) requires the parties to file a Joint Case Management Statement
on or before October 11, 2011;
WHEREAS, Plaintiff has today, on October 11, 2011, substituted counsel in this action and

therefore requires additional time to meet and confer with counsel for Defendant and draft the Joint Case

Management Statement;

WHEREAS, the parties have agreed to a stipulated request to extend the time to file the Joint
Case Management Statement to October 17, 2011;
WHEREAS, the parties are not requesting a continuance of the Case Management Conference

scheduled for October 18, 2011 and plan to proceed on that date, subject to an order of the Court

otherwise;

WHEREAS, the previous time modifications to the case have been limited to the following: on

14

March 2, 2011, the parties stipulated to extend time for Defendant to respond to the complaint, and, on

15

May 5, 2011, the parties stipulated to continue the Initial Case Management Conference;

THEREFORE, pursuant to Local Rule 6-2, and subject to the approval of this Court, the parties,
through their undersigned counsel, hereby stipulate and agree that:

The Joint Case Management Statement shall be filed no later than October 17, 2011.
