Dear Marc,
Thank you for your letter of March 10 regarding the scheduling of the lead counsel meet and
confer.
However, both parties don’t have “scheduling constraints.” Mr. Verhoeven has made himself
available this week for meeting and conferring. Mr. McElhinny has not, and as you point out, is
not available any time in the next two weeks.
Since Samsung is left with no choice in the matter, we will meet with Mr. Jacobs on March 14th
(starting at 1:00) in our San Francisco office, and will seek administrative relief from the inperson lead counsel requirement, or alternatively, relief from case deadlines. Please let us know
whether or not Apple will oppose.
