ORDER REGARDING HEARING ON
PLAINTIFF’S MOTION FOR
PRELIMINARY INJUNCTION

On July 1, 2011, Plaintiff Apple, Inc. filed a motion for preliminary injunction and

20

requested a hearing date of August 5, 2011, five weeks from the date of filing. Based on the

21

parties’ previous representations, it appeared that the parties intended to conduct discovery

22

pertinent to the preliminary injunction motion following the filing of the opening and opposition

23

briefs. It appears that the schedule proposed by Apple would not provide sufficient time for such

24

discovery. Accordingly, the Court requests input from the parties regarding a reasonable time

25

frame for briefing and hearing Apple’s motion. By July 8, 2011, the parties shall file a joint

26

statement, not to exceed 3 pages, proposing a briefing schedule and hearing date. If the parties are

unable to agree upon a proposed schedule, each side may propose a schedule and briefly outline the

reasons supporting the requested schedule.
