Plaintiff, a state prisoner proceeding pro se, filed a civil rights action under 42
17
U.S.C. ยง 1983, by filing a three page document alleging claims regarding his medical care
18
at San Quentin State Prison. On July 27, 2011, the Court dismissed the complaint with
19
leave to amend because the complaint failed to provide information regarding the
20
exhaustion of administrative remedies. (See Docket No. 6.) The Court advised Plaintiff
21
that if he failed to file an amended complaint within thirty days from the date the order is
22
filed, i.e., no later than August 26, 2011, the Court would dismiss this action without
23
prejudice. (See id. at 2.)

The deadline has since passed, and Plaintiff has not filed an amended complaint.
Accordingly, this action is DISMISSED without prejudice.
