(“TiVo”) (collectively, the 1 2 “Parties”), by and through their respective counsel of record, hereby stipulate and agree as 3 follows: 4 This Stipulation of Dismissal is made pursuant to Rule 41 of the Federal Rules of 5 Civil Procedure and agreements between the Parties. 6 WHEREAS, Microsoft filed the above-captioned action (the “Action”) asserting 7 claims against TiVo for alleged infringement of U.S. Patent Nos. 5,731,844, 6,028,604, 5,585,838, 8 and 5,758,258 (collectively, the “Asserted Patents”); 9 WHEREAS, the Parties have agreed that Microsoft will dismiss with prejudice its 10 claims for infringement by TiVo of all of the Asserted Patents. 11 In light of the foregoing, IT IS HEREBY STIPULATED THAT: 12 1. Microsoft's claims against TiVo for infringement of the Asserted Patents are 13 dismissed with prejudice. 14 2.
