This matter came on regularly for a motion hearing on defendant’s motion to dismiss on

December 2, 2011. The court issued a written ruling granting the motion to dismiss with leave to

16

amend on April 23, 2012. An amended complaint was to be filed by May 23, 2012. Plaintiff failed

17

to file an amended complaint. Therefore,

IT IS HEREBY ORDERED that the parties appear on April 26, 2013 @ 9:00 a.m. in

19

courtroom 6 of this Court and show cause WHY THIS CASE SHOULD NOT BE DISMISSED for

20

failure to diligently prosecute.

FAILURE TO APPEAR, THE CASE WILL BE DISMISSED.
