On October 17, 2011, the court granted the parties’ request to stay this matter pending the

resolution of criminal charges against Evan Devito (“Devito”).1 On July 5, 2012, the court ordered
18
that each party submit a letter to the court apprising it of: (1) the present status of Devito’s criminal
19
case; and (2) whether the stay should be lifted.
20
On July 13, 2012, Devito submitted a letter to the court apprising it of the status of his
21
criminal case.2 On July 17, 2012, after reviewing the letter, the court ordered that the stay remain in
22
place.3 On August 9, 2012, Devito submitted another letter to the court, apprising it that the
23
criminal matter had been resolved, and requesting that the court lift the stay.4
