ORDER Granting in Part 32 Motion to Dismiss. The motion to dismiss is GRANTED in part, in that Defendants Martin, Wilson, Ruiz, Meyer, Gudino, Lopez and Krossa are dismissed from this action for Plaintiff's failure to properly exhaust the claims against them. The motion to dismiss is DENIED as to Defendants Powell and Carrasco. No later than fifty-six (56) days from the date of this order, Defendants Powell and Carrasco shall file a motion for summary judgment. Plaitniff's opposi tion to the dispositive motion shall be filed with the Court and served on Defendants no later than twenty-eight (28) days from the date Defendants' Motion is filed. Defendants shall file a reply brief no later than fourteen days(14) days after Plaintiff's opposition is filed. Signed by Judge Edward J. Davila on 12/21/2012.
