The complaint is DISMISSED WITH LEAVE TO AMEND, if Plaintiff wishes, with respect to the E ighth Amendment claim. Within twenty-eight (28) days of the date this order is filed, Plaintiff may file an amended complaint using the court's form complaint. Failure to respond in accordance with this order by filing an amended complaint in the time provided will result in this action continuing solely on the ADA claim.
