On January 4, 2012, the Court issued an order to 16 Respondent to show cause why the petition should not be granted. Respondent has filed a 17 motion to dismiss, alleging that (1) Petitioner has failed to exhaust his claim, and (2) the claim is 18 procedurally defaulted. Petitioner has filed an opposition and motion to hold the proceedings in 19 abeyance. Respondent has filed a reply. Although Petitioner was not granted leave to do so, he 20 has filed a response to Respondent’s reply. Petitioner has also filed a motion to file an amended 21 petition, to which Respondent has filed an opposition. 22 Upon review of these pleadings, the Court has determined that a complete copy of 23 Petitioner’s state habeas petition to the California Supreme Court, No. S191063, would assist in 24 the Court’s consideration of the pending motions. Thus, Respondent is directed to file such copy 25 with the Court no later than January 25, 2013, and serve Petitioner with the same. 26 27 28 IT IS SO ORDERED. DATED: 1/22/13 LUCY H.
