Based on the parties’ Joint Trial Setting Conference Statement, the court has determined an 12 appearance is unnecessary at this time. Accordingly, the Trial Setting Conference is VACATED 13 and the parties are ordered to comply with the following schedule. 14 IT IS HEREBY ORDERED that because Plaintiff has demanded a jury trial, and because 15 there are disputed factual issues upon which a jury must find, the court will schedule this action 16 for a jury trial. 17 IT IS FURTHER ORDERED that pursuant to ADR Local Rule 7-2, the above-entitled 18 case is referred to Magistrate Judge Nathanael M. Cousins for a settlement conference to occur no 19 later than December 11, 2016. All parties are expected 9 to comply as directed above. This schedule will not be amended further absent the presentation of 10 good cause necessitating such an amendment.
