AND REOPENING CASE

Plaintiff, a state prisoner, filed a pro se civil rights action pursuant to 42 U.S.C. §
19
1983. On May 14, 2013, the Court dismissed the instant action for failure to pay the
20
filing fee or file an in forma pauperis (“IFP”) application. (See Docket No. 7.) Although
21
Plaintiff filed an IFP application prior to the closing of this case, the application was
22
insufficient because he failed to attach the following: 1) a Certificate of Funds in
23
Prisoner’s Account completed by an authorized prison official; and 2) a copy of his
24
prisoner trust account statement showing transactions for the last six months. (See
25
Docket No. 5.)

Plaintiff filed a letter dated May 4, 2013, which the Court construed as a notice of
27
intent to prosecute. (Docket No. 6.) In the interest of justice, Plaintiff was provided an
28
opportunity to file the missing documents to complete his IFP application no later than

twenty-eight days from the date of the court order. (Docket No. 9.) Plaintiff has now

filed the missing documents. (See Docket No. 10.) Accordingly, the Judgment entered

on May 14, 2013, (Docket No. 8) is VACATED. The Court will address Plaintiff’s IFP
4
application and conduct an initial screening of the complaint in separate orders.

The Clerk shall reopen the file.
