WHEREAS, subsequent to filing of the initial complaint, it has come to Plaintiff’s attention

that Defendants Printed Circuit Technology, Country Club Cleaners, Inc., and ENS Technology, LLC
3
were incorrectly identified and are not related to the entities listed on the corresponding hazardous
4
waste manifests.

THEREFORE, IT IS HEREBY STIPULATED THAT pursuant to Rule 41(a)(1)(A)(ii) of the
6
Federal Rules of Civil Procedure, Plaintiff Maxim I Properties, Defendant and Cross-claimant Moyer
7
Products, Inc., and the two other Defendants who have appeared in this matter, Telewave, Inc. and
8
Integrated Device Technology, Inc., voluntary dismiss all claims without prejudice brought in this
9
action against the Defendants Printed Circuit Technology, Country Club Cleaners, Inc., and ENS
10
Technology, LLC.
