Ronald M. Whyte Defendants. 22 23 24 25 WHEREAS: 26 A. As more fully described below, plaintiff SHARON R. BROWN ("Plaintiff') and 27 Defendant CITIMORTGAGE, INC. ("Defendant") have agreed to extend Defendant's time to file 28 and serve their response to the first amended complaint ("FAC") in the above-referenced action, in 1 STIPULATION AND ORDER TO EXTEND CITIMORTGAGE INC.’S TIME TO RESPOND 1090903.1 1 order to facilitate ongoing settlement discussions between the parties and a possible resolution of the 2 matter. 3 B. Plaintiffs First Amended Complaint was filed on April 9, 2012. 4 C. Defendants' time to respond to the FAC is June 7, 2012. 5 D. Plaintiff and Defendant are engaged in ongoing settlement discussions and desire to 6 continue to focus their efforts on potential resolution of this matter, rather than incurring litigation 7 costs and expenses; and 8 9 E.
