ORDER GRANTING MOTION FOR RECONSIDERATION AND REOPENING ACTION; GRANTING EXTENSION OF TIME TO FILE COMPLAINT. In the interest of justice, the Court construes the letter as a motion for reconsideration, and for good cause shown, GRANTS the motion. The Clerk shall reopen this action. Plaintiff shall submit a complaint within thirty (30) days of the date this order is filed. Complaint on Form due by 11/4/2012. Failure to file a complaint in accordance with this court order in the time provided will result in the dismissal without prejudice of this action without further notice to Plaintiff. Judgment was entered the same day. 20 Plaintiff has filed a letter stating that he did not receive the last court order 21 granting him an extension of time to file a complaint until after the deadline had expired. 22 (Docket No. 12.) Plaintiff states that he was away at a hospital for a medical procedure 23 from August 28, 2012 until September 1, 2012, and that he was still recovering from the 24 procedure until September 17, 2012, when he finally received his personal property, 25 including the aforementioned court order. (Id.) In the interest of justice, the Court 26 construes the letter as a motion for reconsideration, and for good cause shown, GRANTS 27 the motion.
