Whereas Plaintiff no longer asserts any claims for judicial foreclosure and
breach of guaranty in the above entitled case;
Whereas the Smeads, SVI and O’Hanneson have entered into a settlement

agreement pertaining to their cross-claims asserted in the above entitled action,

which settlement was approved on or about March 26, 2013 by the U.S. Bankruptcy
