Stipulation Amending Case Management Order

In its Case Management Order of November 27, 2012, the Court set the discovery cutoff to

May 14, 2013, and the last day to file dispositive motions as July 15, 2013. By Stipulation and

Order, the parties agreed to continue the discovery cutoff date from May 9, 2013, to July 17, 2013.

A mediation session was held on April 18, 2013, which did not result in a settlement.

Recently, however, the parties have resumed settlement discussions with the assistance of the

6

mediator. Those discussions have occurred over the past month and are expected to require

7

additional time towards reaching agreement and, thereafter, preparing a settlement agreement

8

acceptable to both parties.
