Plaintiff, a California state prisoner proceeding pro se, filed an amended civil rights
18
complaint pursuant to 42 U.S.C. § 1983 and Bivens v. Six Unknown Named Agents, 403 U.S.
19
388, 392-97 (1971). On February 7, 2013, the Court screened Plaintiff’s amended complaint,
20
and dismissed it with leave to amend. Plaintiff was directed to file a second amended complaint
21
within thirty days. Plaintiff has filed a motion for an extension of time of ninety days to file his
22
second amended complaint. (Doc. No. 9.)

Plaintiff’s motion for an extension of time to file a second amended complaint is
24
GRANTED in part. Plaintiff shall file a second amended complaint within sixty (60) days from
25
the date this order is filed.
