ORDER DISMISSING CASE
On April 26, 2013, the parties filed a stipulation in which the parties state that they have

entered into a Settlement Agreement, and stipulate to the following:

1. That the sum of $115,000.00 on deposit in the Court's registry, plus any interest accrued
19
thereon, be disbursed to Defendant and Counter-Plaintiff Superior Foods, Inc. with the
20
check made payable to “Superior Foods, Inc.” and delivered to its counsel: McCarron &
21
Diess, Attn: Kate Ellis, Esq., 4530 Wisconsin Ave., NW, Suite 301, Washington, DC
22
20016; and
23
2. Pursuant to Fed. R. Civ. P. 4l(a)(l)(A)(ii), that this case be dismissed with prejudice.

The parties’ stipulation is GRANTED. The case is dismissed with prejudice and the sum of
26
$115,000.00 on deposit in the Court’s registry, plus any interest accrued thereon, shall be disbursed
27
to Superior Foods, Inc. with the check made payable to “Superior Foods, Inc.” and delivered to its
