On February 6, 2015, the court issued an Order to Show Cause which required Plaintiff

Nelson Garcia (“Plaintiff”) to either file, by February 13, 2015, a document providing an update
15
on the status of related state criminal proceedings or otherwise show cause in writing why this
16
action should not be dismissed for failure to prosecute or failure to comply with a court order
17
pursuant to Federal Rule of Civil Procedure 41(b). See Docket Item No. 16. As of the date and
18
time this order was filed, Plaintiff has not complied with the show cause order as directed.

Accordingly, this action is DISMISSED pursuant to Federal Rule of Civil Procedure 41(b).
