Plaintiff, a state prisoner proceeding pro se, filed a complaint pursuant to 42

18

U.S.C. § 1983 against Avenal State Prison officials. Plaintiff claims that Defendants

19

denied him adequate medical accommodations by refusing him the use of a wheelchair in

20

violation of his Eighth Amendment rights. Because the acts complained of occurred in

21

Kings County, which lies within the venue of the Eastern District of California, venue

22

properly lies in that district and not in this one. See 28 U.S.C. § 1391(b). Accordingly,

23

this case is TRANSFERRED to the United States District Court for the Eastern District

24

of California. See 28 U.S. C. § 1406(a). The Clerk shall terminate all pending motions

25

and transfer the entire file to the Eastern District of California.
