Having Considered the Stipulation of the Parties, the Court hereby Orders as follows:

This action shall be dismissed without prejudice.

The Court shall retain jurisdiction to enforce the terms of the settlement.

Should plaintiff re-file this action, the parties agree that any applicable statute of

limitations shall be tolled, and governed by the date of the filing of the initial complaint in this
24
action (May 6, 2013).
The Clerk shall close the file.
