(“Plaintiff”), pursuant to 2 Federal Rule of Civil Procedure 41(a)(1)(A)(i), hereby voluntarily dismisses all claims in this 3 action without prejudice as to Defendant Andreessen Horowitz LLC only. This dismissal has no 4 effect on Plaintiff’s claims against the remaining defendants. Plaintiff and defendant Andreessen 5 Horowitz LLC shall bear their own costs and attorney’s fees. 6 Federal Rule of Civil Procedure 41(a)(1)(A)(i) provides: 7 8 9 10 11 12 (a) Voluntary Dismissal. (1) By the Plaintiff. (A) Without a Court Order. Subject to Rules 23(e), 23.1(c), 23.2, and 66 and any applicable federal statute, the plaintiff may dismiss an action without a court order by filing: (i) a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment[.] 13 14 15 16 Fed. R. Civ. P. 41(a)(1)(A)(i). Defendant Andreessen Horowitz LLC has not answered Plaintiff’s Complaint or First 17 Amended Complaint, or filed a motion for summary judgment.
