On December 6, 2013, the court dismissed the case and entered 19 judgment because plaintiff failed to timely pay the filing fee or file a motion for leave to proceed 20 in forma pauperis. 21 On December 23, 2013, plaintiff filed a notice of appeal to the Ninth Circuit Court of 22 Appeals. On January 2, 2014, the Ninth Circuit Court of Appeals assigned a case number to 23 plaintiff’s appeal and set a briefing schedule.
