DataTern, Inc., No. 20131184, and SAP AG, et. al. v. DataTern, Inc., No. 2013-1185, 2014 U.S. App. LEXIS 6219 (Fed. Cir. Apr. 4, 2014) (op. attached). DataTern is directly relevant to multiple issues in the pending motion to dismiss.
