Non-Expert discovery shall be completed by 11/30/16. The Court sets a deadline of 1/18/17 to disclose experts. Cross motions for summary judgment shall be filed by 1/18/17. The Court is amenable to affording the parties extra pages in order to address the Spokeo issue, should a request for a reasonable increase be necessary. The parties shall meet and confer and submit a stipulation regarding a briefing and hearing schedule for cross motions and a deadline to complete ADR for the Court's review. The hearing shall be no less than 3 weeks from the date the reply briefs are filed. In order to ensure that the additional discovery is confined to the limitations necessitated by the Court's class certification ruling, three discrete discovery disputes re: updated source code, scope of word search and configuration table will be resolved by Judge Hamilton. The parties shall meet and confer and attempt to resolve these disputes, but if they are not resolved the moving party may file a separate brief not to exceed 10 pages for each of the three disputes. A response may be filed 7 days thereafter and shall also not exceed 10 pages. No replies. The Court will contact counsel should a telephonic hearing be required. All other discovery disputes shall remain before the magistrate judge. However, due to Magistrate Judge James' unavailability during a portion of the fall, all discovery is now referred to Magistrate Judge Sallie Kim. REFERRALS: [x] Case referred to ADR for Mediation with Ms. Yanni, to be completed before the hearing on dispositive motions.
