Pursuant to ADR Local Rules 6–3(a) and 2–5(d)(4), Defendant Facebook, Inc. respectfully

objects to the appointment of Mark Petersen as a mediator for this matter. (See Dkt. No. 97.)

Although Facebook appreciates Mr. Petersen’s willingness to serve as a mediator in this case,

Facebook is currently adverse to his firm (Farella, Braun & Martel LLP) in another litigation matter

5

pending in the Superior Court of California. (See http://www.fbm.com/Ferrari_and_Facebook_

6

Sued_Over_Enormously_Popular_Facebook_Fan_Pages_10-15-2014/). Under the circumstances,

Facebook respectfully requests reassignment to another mediator.

Facebook has conferred with counsel for Plaintiffs regarding this objection, and Plaintiffs do
not oppose assignment to another mediator, as long as the parties are able to obtain a prompt

reassignment and still meet their existing deadline of August 24, 2015 for the mediation. (See Dkt.

11

No. 81.)
