UNKNOWN, Defendant. ) ) ) ) ) ) ) ) ) ) No. C 14-0175 RMW (PR) ORDER OF DISMISSAL 16 17 On December 20, 2013, plaintiff, proceeding pro se, filed a letter in the Eastern District 18 of California, which commenced this action. On January 2, 2014, the Eastern District transferred 19 this action to the Northern District of California. On January 13, 2014, the clerk notified 20 plaintiff that he had not paid the filing fee, nor had he filed an application to proceed in forma 21 pauperis (“IFP”). The clerk also notified plaintiff that he failed to submit a complaint. Along 22 with the deficiency notices, plaintiff was provided with a new IFP application and instructions 23 for completing it. Plaintiff was further cautioned that his failure to either file a completed IFP 24 application or pay the filing fee within thirty days would result in the dismissal of this action. In 25 addition, plaintiff was advised that his failure to file a complaint within thirty days would result 26 in the dismissal of this action. To date, plaintiff has not paid his filing fee, filed a completed IFP 27 application, or filed a complaint. 28 Order of Dismissal P:\PRO-SE\RMW\CR.14\Blanton175disifpcomp.wpd 1 2 3 4 Thus, the instant action is DISMISSED without prejudice.
