On October 15, 2014, Plaintiff filed a letter which was construed as an attempt to

file a complaint pursuant to 42 U.S.C. § 1983. On the same day, the Clerk sent Plaintiff a

16

notice that his civil action was deficient because he did not pay the filing fee or file an In

17

Forma Pauperis (“IFP”) application. (Docket No. 3.) The notice included the warning

18

that Plaintiff must respond within twenty-eight days to avoid dismissal of this action.

19

(Id.) A separate notice was sent directing Plaintiff to file a proper complaint within

20

twenty-eight days to avoid dismissal of the action. (Docket No. 2.) The deadline has

21

passed, and Plaintiff has not filed an IFP application or paid the filing fee, nor has

22

Plaintiff filed a proper complaint. Accordingly, Plaintiff’s case is DISMISSED without

23

prejudice.

The Clerk shall terminate any pending motions and close the file.
