United States District Court Northern District of California 11 12 SANTA CRUZ COUNTY, et al., Defendants. 13 ORDER RE PLAINTIFF'S REQUEST FOR CLARIFICATION ON OPERATIVE COMPLAINT FOR PURPOSES OF SERVICE OF SUMMONS AND COMPLAINT [ECF 94] 14 15 16 17 On October 26, 2015, the Court issued an order granting Plaintiff’s request for an extension of time until February 25, 2016 to effect service of process. Order, ECF 82. On December 14, 2015, Plaintiff filed a Request for Clarification on Operative Complaint 18 for Purposes of Service of Summons and Complaint. Pl.’s Request, ECF 94. In relevant part, that 19 document states that “Plaintiff respectfully requests the Court clarify that the Amended Second 20 Amended Complaint is the operative complaint for purposes of serving the remaining defendants 21 in this case that have not yet received service of the summons and complaint.” Id. at 1. 22 Plaintiff appears to be seeking legal advice to aid him in effecting service of process. It is 23 not appropriate to direct that type of inquiry to the Court. The docket reflects that the Amended 24 Second Amended Complaint filed on November 18, 2015 as ECF 90 is the most recent complaint 25 and therefore the operative complaint. The Court cannot comment further. 26 Plaintiff may wish to contact the Federal Pro Se Program, a free program that offers 27 limited legal services and advice to parties who are representing themselves.
