1 UNITED STATES DISTRICT COURT 2 NORTHERN DISTRICT OF CALIFORNIA 3 SAN JOSE DIVISION 4 5 SHELBY GAIL HEIFETZ, Case No. 5:15-cv-05726-EJD Plaintiff, 6 ORDER TO SHOW CAUSE v. 7 8 TEXAS TURKEYS, INC., et al., Defendants. 9 10 On September 3, 2014, the Clerk issued a notice consistent with General Order No. 56 United States District Court Northern District of California 11 which required the parties to, inter alia, conduct a site inspection by March 28, 2016, meet in 12 person to discuss settlement within 28 days thereafter, and file a notice of need for mediation 13 within 42 days of the site inspection if settlement discussions were unsuccessful. According to 14 this schedule, Plaintiff should have filed or caused to be filed the mediation notice no later than 15 May 9, 2016. Plaintiff did not and has not done so. 16 Accordingly, the court hereby issues an order to show cause why this action should not be 17 dismissed for failure to prosecute. If Plaintiff does not, by May 31, 2016, file or cause to be filed 18 a Notice of Settlement, a Notice of Need for Mediation as indicated in Section 7 of General Order 19 No. 56, or otherwise demonstrate good cause in writing why this case should not be dismissed, the 20 court will dismiss the action with prejudice pursuant to Federal Rule of Civil Procedure 41(b).
