Case No. 16-cv-05597-HRL
ORDER TO SHOW CAUSE RE:
NEW JERSEY'S RESTAURANT,
On March 14, 2017, the court issued an order setting a status conference for April 4, 2017.
Dkt. No. 8. The order setting a status conference indicated that no defendant had been served. Id.
On March 31, 2017, plaintiff filed a purported summons returned executed. Dkt. No. 9. The
plaintiff then failed to appear at the status conference on April 4, 2017. Dkt. No. 10. The plaintiff
did not file a request to continue or vacate the status conference, and the court did not
communicate that the status conference had been moved or taken off the calendar. As a result, the
court orders counsel for the plaintiff to appear on April 25, 2017, at 10:00 AM, in Courtroom 2,
Fifth Floor of the United States District Court, 280 South First Street, San Jose, California, and
show cause, if any, why sanctions should not issue for counsel’s disregard of the court’s order
setting a status conference.
IT IS SO ORDERED.
HOWARD R. LLOYD
United States Magistrate Judge
