The dismissal is with prejudice for those Defendants who own land outside the boundaries of the Anza-Cahuilla Sub-Basin as defined by Interlocutory Judgment 33 and who did file an answer; Pechanga Band of Luiseno Indians request for a 60 day s tay of their dismissal for the purpose of completing settlement negotiations is granted; Defendants who oppose their dismissal may file a Motion to Intervene; Plaintiff-Intervenors' 5110 Joint Motion to File Second Amended Complaint is granted ; Defendant who are dismissed pursuant to this Order and filed either an answer or waiver may file a Motion for Attorneys Fees and Costs with supporting briefs and documentation; motion papers due by 5/18/09; Oppositions due by 6/19/09; Reply briefs due by 6/15/09; Plaintiff-Intervenors' Request for continuation of Stay for six months is granted; (Written Status Reports due by 6/29/09; 8/28/09 and 10/28/09). The stay is lifted for the limited purposes 1) filing and serving the Second Amend ed Complaint; 2)settlement conferences before Magistrate Judge Brooks 3)Motions to Intervene by dismissed Defendants 4) Motions for Attorneys' Fees and Costs by Defendants who filed either an answer or waiver.
