Petitioner Marcus Threats ("Petitioner"), a state prisoner proceeding pro se, filed a first amended petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254, challenging his San Diego County Superior Court conviction. (Doc. No. 4.) Respondent1 filed an Answer and Memorandum of Points and Authorities, and Petitioner filed a Traverse. On January 5, 2010, Magistrate Judge Anthony J. (Doc. No. 13.) To date, Petitioner has not filed objections. The Court HEREBY ADOPTS Magistrate Judge Battaglia's well-reasoned Report and Recommendation in its entirety, and DENIES the first amended petition for writ of habeas corpus.
